In a move to tighten its grip on sensitive chip technologies and equipment, the United States has announced a fresh set of updates to its export controls. The new regulations, which came into effect on April 4th, target advanced computing, supercomputers, semiconductor end-uses, and semiconductor manufacturing products. The goal is to prevent certain countries and businesses from circumventing U.S. restrictions.

While these measures may seem stringent, industry analysts at TrendForce believe that the practical impact on the tech sector will be minimal. The updates primarily refine the language and parameters of previous regulations, with a particular focus on exports to Macau and D:5 countries (China, North Korea, Russia, Iran, etc.). The criteria for exports have been tightened, requiring a detailed examination of a product’s Total Processing Performance (TPP) and Performance Density (PD). If a product exceeds certain computing power thresholds, it must undergo a case-by-case review.

However, there is a provision called Advanced Computing Authorized (ACA) that allows for specific exports and re-exports among selected countries. This provision even permits the transshipment of certain products between Macau and D:5 countries. Notably, the extension of export controls now covers not only previously restricted AI chips from nVidia and AMD but also their next-generation successors.

HPC manufacturers have swiftly responded to these updates by developing products that comply with the new TPP and PD standards. For example, NVIDIA has adjusted its H20/L20/L2 models to ensure they remain eligible for export.

Despite the emphasis on stricter reviews for products exceeding computing power limits, the overall impact on the industry is expected to be insignificant. This is because the updates primarily aim to close existing regulatory loopholes rather than create significant barriers. For instance, consumer GPUs like NVIDIA’s RTX 4090, which were previously restricted due to their computing power, are now allowed for export.

Ironically, these efforts by the U.S. to hinder China’s access to advanced technologies may inadvertently accelerate China’s progress in developing AI chips and advanced manufacturing processes. In its pursuit of technological superiority, the U.S. may unintentionally fuel the very advancements it seeks to impede.
