Lenovo Takes ASUS to US ITC Over Patent Infringement

Lenovo, the global technology corporation, has taken legal action against ASUSTeK Computer Inc. and ASUS Computer International (ASUS) for alleged patent infringement. The lawsuit, filed with the United States International Trade Commission (ITC), claims that ASUS has infringed on several of Lenovo’s patents related to software, hardware, and connectivity in multiple ASUS products.

This legal battle stems from ASUS’s own filings in the Regional Court of Munich in August 2023, which were related to cellular technologies. At that time, Lenovo had proposed a cross-licensing deal as a potential resolution. Lenovo has always been an advocate for cross-licensing agreements and fair negotiations within the industry. The company believes in transparent discussions and licensing on fair, reasonable, and non-discriminatory (FRAND) terms.

Lenovo’s commitment to protecting its technological innovations and industry “firsts” is evident in its ongoing litigation with InterDigital. The company has consistently pushed for greater transparency and fairness in licensing negotiations. The UK Court has even recognized Lenovo as a willing licensee in this regard.

John Mulgrew, Lenovo’s Deputy General Counsel and Chief Intellectual Property Officer, emphasized the need for balance in licensing and asserted their patent portfolio more actively. Mulgrew stated that some licensors are bypassing FRAND discussions and resorting to threats to extract inflated royalties from licensees. Lenovo believes that mutual respect, openness, fairness, and third-party assistance with FRAND negotiations can lead to a better approach.

While litigation is always a last resort for Lenovo, the company believes it must protect its intellectual property while promoting transparency in licensing. This approach ensures ongoing investment in innovation and allows customers worldwide to benefit from affordable technology.
